As an internet service provider, Substream4K is entitled to claim immunity from copyright infringement claims under the DMCA "safe harbor" provisions, provided that valid notices of alleged infringement are handled correctly.
To submit a good-faith copyright infringement complaint, you must provide a written notice containing the information listed below.
A DMCA notice must include the following:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
- Identification of the copyrighted work alleged to have been infringed;
- Identification of the content alleged to be infringing and requested for removal, along with sufficient information to locate it. Please provide the exact URL where the content appears;
- Contact details of the complainant, including name, postal address, email address, phone number, and fax number if applicable;
- A statement that the complainant has a good-faith belief that the use of the material is not authorised by the copyright owner, their representative, or the law;
- A statement that the information in the notice is accurate, and, under penalty of perjury, that the complainant is authorised to act on behalf of the copyright owner.
Title 17 U.S.C. §512(f) provides for civil liability, including damages, costs, and attorney's fees, for any person who knowingly and materially misrepresents information in a DMCA notice.

Please note that we may share the identity and information provided in an infringement complaint with the person the complaint is directed against. By submitting a complaint, you acknowledge and accept that your identity and complaint may be disclosed to the relevant party.
If you believe that content has been removed or disabled by mistake or as a result of misidentification, you may submit a counter-notice to have it restored.
The counter-notice must be submitted in writing and must, in accordance with Section 512(g)(3) of Title 17 of the United States Code, include:
- Your physical or electronic signature;
- A description of the material that was removed and its original location before removal;
- A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled by mistake or as a result of misidentification;
- Your name, address, and phone number, along with a statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located, or, if you are outside the United States, in any judicial district where the service provider may be located, and that you accept service of process from the person who submitted the original DMCA notice.
